Terms of Service – Defapp

1. Scope

These Terms govern the use of the mobile application “Defapp” (“App”).

By installing or using the App, you agree to these Terms.

The App is operated by Jens Remer, Berlin, Germany (“Provider”).

2. Nature of the Service

Defapp provides:

  • Local alarm functionality
  • Voluntary emergency alert transmission
  • Optional Nearby features
  • Public Area communication
  • Optional short evidence video recording

The App provides technical communication support only.

Defapp is not an official emergency service and does not replace emergency numbers.

There is no guarantee of assistance, response, or successful message delivery.

3. Use of the App

The App operates without traditional user accounts and uses pseudonymous technical identifiers.

You agree to use the App in compliance with applicable laws.

Certain features require activation by you.

4. Defense Mode and Video Recording

The defense mode may only be used in legitimate emergency or defense situations.

Video recording occurs only after you actively trigger the function.

You are solely responsible for:

  • creating
  • storing
  • transmitting
  • ensuring the legality of any recording

The Provider does not store or review videos.

Misuse, including unjustified surveillance or recording of third parties, is prohibited.

5. Strobe Light Function in Defense Mode

In defense mode, an optional strobe light function may be activated.

The strobe light emits rapidly flashing light pulses and is intended solely to attract attention or potentially disorient an attacker.

Use of this feature is voluntary and at your own responsibility.

Rapid flashing lights may trigger adverse health reactions in sensitive individuals, particularly those with photosensitive epilepsy or other neurological conditions.

You are responsible for using this function only in appropriate situations and with consideration of potential health risks.

The statutory liability provisions set out in the “Liability” section remain unaffected.

6. Nearby and Community Features

Participation in Nearby and Public Area features is voluntary.

There is:

  • No guarantee of delivery
  • No obligation to respond
  • No obligation to provide assistance
  • No guarantee that alerts will be received

All decisions to provide help are made independently by users.

7. Defapp Pro

Certain features may require a paid subscription (“Defapp Pro”).

Payments and subscription management are handled exclusively by Apple or Google.

The respective App Store terms also apply.

8. Availability

The Provider strives to ensure high availability but does not guarantee uninterrupted access or successful alert transmission.

Functionality may be affected by technical issues, network disruptions, third-party services, or force majeure events.

9. Liability

The Provider is fully liable in cases of:

  • Intent
  • Gross negligence
  • Injury to life, body, or health

In cases of ordinary negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damage.

To the extent permitted by law, liability for non-delivery of alerts, lack of assistance by third parties, misuse of the App, or technical failures beyond the Provider’s control is excluded.

10. Suspension

The Provider may restrict or suspend access in cases of unlawful or abusive use.

11. Data Protection

Details regarding data processing are described in the Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections in your country of residence.

13. Jurisdiction

If you are not a consumer, the exclusive place of jurisdiction is Berlin, Germany.

For consumers, statutory jurisdiction rules apply.

14. Severability

If any provision of these Terms is invalid, the remaining provisions remain unaffected.
